| NOTICE OF TRUSTEE'S SALE OF REAL ESTATE: WHEREAS, by Deed of Trust dated May 14, 2008, and recorded in Book T631, pages 322-332, in the Register's Office of Weakley County, Tennessee, MITCHELL W. VANCLEAVE and ALBERTA L. VANCLEAVE, husband and wife, conveyed to Michael W. Hagan, Trustee, the hereinafter described real property to secure the payment of a certain promissory note (the “Note”) described in the Deed of Trust, which Note was payable to Reelfoot Bank; and WHEREAS, default has been made in the payment of the Note; and WHEREAS, Reelfoot Bank, now the owner and holder of the Note, has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure, in accordance with the terms and provisions of the Note and Deed of Trust. NOW, THEREFORE, by virtue of the authority in me vested as Trustee under said instrument, this is to give notice that I will on January 3, 2013, at 10:00 a.m. proceed to offer for sale and sell at public outcry in front of the Courthouse in Dresden, Weakley County, Tennessee, and to the highest and best bidder for cash, the following described property, to wit: Land located in the 10th Civil District of Weakley County, Tennessee: BEGINNING at a stake in the south margin of the blacktop on a road known as Bynum Road at the northeast corner of a the parcel conveyed to David L. and Martha J. Reid by Mavis O. Reid and Doris Ann Reid on April 29, 1988, the same being the northwest corner of the parcel herein described and runs thence south with David L. and Martha J. Reid's east line 175 feet to their southeast corner; thence east, parallel with Bynum Road and making a new line, 134 feet to a stake; thence north, making another new line, 175 feet to the south margin of the blacktop on Bynum Road; thence west 134 feet with said road to the beginning, containing 1/2 acre, more or less. It being the same conveyed to Mitchell W. Vancleave and wife, Alberta L. Vancleave by Deed of Betty J. Armstrong, a widow, dated May 7, 2007, and of record in Deed Book D406, Page 888, ROWCT. On the above tract is located is a 1995 Fleetwood Mobile Home, VIN MSFLR25A34966OG and MSFLR25B349660G (See Affidavit of Affixation of record in Book D410, Page 513, Register's Office of Weakley County, Tennessee). Map 122, Parcel 28.03. The address of the above described property is believed to be 506 Bynum Road, Dresden, Weakley County, Tennessee, however, the legal description provided above shall control. Said sale will be held subject to any and all taxes that may be a lien against said property, restrictive covenants, easements and all other matters of record. All right of redemption, statutory and otherwise, homestead and dower are expressly waived in said Deed of Trust, and the title is believed good, but the undersigned Trustee will sell and convey only as Trustee, subject to any prior deeds of trust, real estate taxes, assessments, covenants, easements, restrictions and liens. Other interested parties or liens are as follows: Subject to a Clay Lease given by C.B. Reid and wife, Iva Mae Reid, to United Clay Mines Corporation, dated March 7, 1956, and of record in Deed Book 115, Page 497, ROWCT. Said Lease was assigned to Cyprus Mines Corporation by Assignment dated September 8, 1965, and of record in Deed Book 126, Page 368, ROWCT. Clay Lease has now been assigned to United Clay Inc. by Assignment dated March 31, 1989, and of record in Deed Book 297, Page 1, ROWCT. There has been full compliance with the requirements of T.C.A. § 35-5-117 regarding the notice of the right to foreclose. The Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. If the highest bidder cannot pay the bid in full upon such terms as are announced at the sale, the next highest bidder, at their highest bid, will be deemed the successful bidder.
