TRUSTEE'S NOTICE OF SALE: WHEREAS, by Deed of Trust executed by JOSEPH L. JENKINS and wife LORI M. JENKINS, to RALPH HENSON, Trustee, conveying their interest in the property described therein to secure the payment of a Promissory Note dated November 20, 2009, and all renewals or extensions thereof, said note being payable to First Citizens National Bank, said obligation being payable as set forth in the deed of trust aforesaid, which was recorded in the Register's Office for Weakley County, Tennessee, in Trust Book T644, page 962, which reference is here made; and,
WHEREAS, a Notice of the Right to Foreclose, if required pursuant to T.C.A. §35-5-117, was given at least sixty (60) days prior to the first publication in accordance with Tennessee law; and
WHEREAS, the Substitute Trustee caused a diligent search of the Defense Manpower Data Center (DMDC) website for each known Borrower in compliance with the Service Members Civil Relief Act, and as such the foreclosure of this property is not subject to the provisions of 50 U. S. C. §501, et seq.; and,
WHEREAS, default has been made in the payment of said abovementioned indebtedness and FIRST CITIZENS NATIONAL BANK, the holder of said note has declared the entire amount due and payable as provided for in said Note and Deed of Trust, and the undersigned, RALPH HENSON, Trustee, in accordance with the terms and conditions of said note and Deed of Trust will sell the hereinafter described real estate at public outcry for cash to the highest and best bidder on June 17, 2013 at 10:45 A. M. at the South door of the Courthouse in Weakley County, Tennessee, to-wit:
Situated in the 2nd Civil District of Weakley County, Tennessee, and being more particularly described as follows:
BEGINNING at a stake in the west right of way of Highway 89; Copeland's southeast corner and the northeast corner of the tract being conveyed; thence in a westerly direction with Copeland's south line, 92 feet, more or less, to a stake, Copeland's ell corner; thence in a northerly direction with one of Copeland's West lines 25 feet, more or less, to a stake, Copeland's corner; thence in a westerly direction with one of Copeland's south lines 52 feet, more or less, to a stake, another of Copeland's corners; thence in a southerly direction with one of Copeland's east lines 25 feet, or more or less, to a stake another of Copeland's ell corner; thence in a westerly direction with Copeland's south line 123 feet, more or less, to a stake in Gatewood's East line; thence in a southeasterly direction with Gatewood's East line 150 feet to a stake; thence in an easterly direction, making a new line through Gatewood, 150 feet, more or less, to the west right of way of Highway 89 in the center of a concrete culvert; thence in a northerly direction with the west right of way of Highway 89, 120 feet to the point of beginning.
Being further identified as Map 62, Parcel 50.00, in the records of the Tax Assessor's Office for Weakley County, Tennessee.
Being the same property conveyed to Joseph L. Jenkins and wife Lori M. Jenkins by deed of record in Deed Book D414, page 1100, ROWCT.
THIS PROPERTY ALSO KNOWN AS: 4437 Highway 89, Dresden, TN 38225.
Said property will be sold free from all equities of redemption, and repurchase and dower and the statutory right of redemption, all of which were specifically waived, but subject to any and all restrictions of record, all unpaid taxes that may be a lien against the property, and subject to any and all other rights or liens having priority over the Trust Deed in accordance with the laws of the United States of America, including but not limited to liens having priority under the United States Bankruptcy code, and the Laws of the State of Tennessee.
