Kidnapping charge tossed out of court



A Martin man accused of kidnapping his girlfriend and putting a gun to her head had his charges amended last week in Weakley County General Sessions Court.
Johnathan David Winston of Adams Road in Martin was arrested by the Weakley County Sheriff’s Department Nov. 27, 2009.
According to court affidavits, Winston had allegedly put a gun to his girlfriend’s head and forced her into a maroon Ford Explorer that night.
The affidavit further states Winston told his girlfriend to throw out two guns from the vehicle before he was stopped by sheriff’s deputies.
Officers recovered one of the weapons in a ditch on Adams Road, according to the affidavit.
Winston was originally charged with tampering with evidence, especially aggravated kidnapping, DUI 1st offense, and domestic aggravated assault.
The domestic aggravated assault charge was amended last week in Weakley County General Sessions Court to a simple assault charge. The tampering with evidence and especially aggravated kidnapping charges were dismissed.
He was also charged with violation of probation. Winston was ordered to serve all but 85 days of an 11-month 29-day sentence in the Weakley County Detention Center.
